InLinkUK Terms of Use

  1. Introduction
    1. These terms and conditions (“Terms”) set out the agreement between Link OHH Limited, (“we”, “us” or “our”) and anyone accessing the free of charge wireless internet network service, including our public communication structures (and their affixed tablets) (“Service”) provided by us (“you” or “your”). In consideration for registering your email address to access our Service on your personal device, we will provide our Service to you in accordance with and subject to these Terms. These Terms are the terms and conditions that govern your access to, and use of, the Service.
    2. These Terms create a legally binding agreement between you and us. By accessing and using our Service, you accept and agree to these Terms and our privacy policy (“Privacy Policy”). If you do not agree to these Terms and our Privacy Policy, you should not use our Service.
    3. While all of these terms are important, you should pay particular attention to:
      1. the restrictions on your use of our Service (clause 3.1);
      2. what you acknowledge and agree to in order to use our Service (clauses 3.3, 3.4 and 3.5);
      3. our liability to you (clause 6); and
      4. Changes to these Terms and/or our Service (clause 8).
    4. By accessing and using our Service you acknowledge that you are over the age of eighteen (18), or if you are under the age of eighteen (18), you have obtained consent from your parent or guardian before accessing and using our Service.
    5. These Terms apply to you from when you access our Service and continue to apply until such time as your access or our Service is terminated in accordance with clause 7.
    6. We recommend that you print, download or save a copy of these Terms and our Privacy Policy for future reference.

  2. Accessing our Service
    1. To access and use our Service, you will need a device that meets the minimum technical requirement of IEEE 802.11g or 802.11a Wi-Fi standards (“Device”). We provide an encrypted Wi-Fi connection for compatible devices to use our encrypted access, you will require a device that supports Passpoint TM. To determine whether your device is compatible please visit here.
    2. Our Service can be accessed under the network name “InLinkUK provided by BT”. If this changes, we will notify you via email using the address you used to register for the service.
    3. After you have registered to use our Service, where possible, we will use our reasonable endeavours to automatically connect you to our Service each time you are within range of a Wi-Fi hotspot, subject to clause 7.
    4. All the registration information you submit must be truthful and accurate. If for any reason any information you submit becomes untruthful, inaccurate and/or incomplete, you agree that you will update that information to maintain its accuracy.

  3. Using our Service
    1. You must only use our Service for lawful purposes and for your own personal use.
    2. You may not use our Service for:
      1. commercial or business use, unless you have obtained written consent from us to do so; or
      2. any of the following activities, or to encourage others to carry out any of the following activities: (i) any harmful or illegal activities; (ii) hacking into any system or network; (iii) introducing any viruses, bugs, worms, spyware, malware, ransomware, trojan horse, logic bombs or other program or code into any device, computer, computer system, software or disks; (iv) activities intended to aid any crime, including identity theft, credit card theft, exploitation of minors, or indecent images of minors; (v) violating any copyright laws by making unauthorised copies of copyrighted or licensed software, data, entertainment files, text or publications (“Works”), or making such Works available to others without first obtaining consent or a licence from the owner of such Works; (vi) downloading, uploading, accessing, streaming, posting, emailing, transmitting or otherwise making available any materials that infringe any patent, trademark, trade secret, copyright or other proprietary rights (“Intellectual Property Rights”) of the owner of such Intellectual Property Rights; (vii) participating in or committing telecommunications fraud; (viii) activities which will damage, disable, vandalise or otherwise harm computer equipment or software; (ix) carrying out any acts that are harassing, defamatory, threating, obscene, abusive, racist, sexist, offensive, indecent or constitute inappropriate behaviour to another; (x) activities that damage our name and/or reputation; or (xi) collect email addresses or other personal details without such persons’ consent or send any emails that may reasonably be considered as spam by the recipient.
    3. You must not misuse our Service by knowingly introducing viruses, bugs, worms, spyware, malware, ransomware, trojan horse, logic bombs or other material that is malicious or technologically harmful.
    4. You must not attempt to gain unauthorised access to our Service and must not attack our Service via a denial-of-service attack or a distributed denial-of service attack.
    5. By using our Service, you acknowledge and accept:
      1. our Service may be accessed by an unauthorised third party who may, or may attempt to, disrupt, abuse, damage or cause harm to our Service in way that does not conform with these Terms, and such acts may cause loss or damage to you or your Device;
      2. we cannot guarantee under any circumstances that our Service is: (i) free of any interruptions or errors; (ii) secure or private; and (iii) free of viruses, bugs, worms, spyware, malware, ransomware, trojan horse, logic bombs or other program or code that may cause harm to your Device;
      3. that while our Service contains a content filter to prevent your access to material on internet sites that may be harmful, graphic, offensive or contain illegal content, no content filter is completely effective and you may be exposed to material on internet sites that may be harmful, graphic or offensive to you;
      4. we (or our licensors) own all Intellectual Property Rights in our Service, whether registered or unregistered. Nothing in these Terms grants you a licence to use or reproduce any Intellectual Property Rights in our Service, except that you have a limited licence to use our Service subject to and in accordance with these Terms; and
      5. the potentially serious risks of accessing a publically available free wireless internet network service (such as our Service).
    6. We reserve the right (but have no obligation) to investigate and/or take appropriate action against you if you violate these Terms or otherwise create liability for us or any other person – the action we take will be determined by us acting in our sole discretion. Examples of action that we might take could include: terminating your access to our Service and/or this contract in accordance with Section 7.1, and/or reporting you to law enforcement authorities.
    7. If you provide us with any feedback or suggestions regarding the Service (“Feedback”), you hereby transfer to us all rights in such Feedback. You also agree that we shall have the right to use and fully exploit such Feedback and related information in any manner we consider appropriate. Please note that the Feedback you provide to us will not be treated as confidential information – accordingly, you agree not to submit to us any information or ideas that you consider to be confidential or proprietary.

  4. Protecting you and your Device
    1. We encourage you to take steps to minimise any loss or damage to you or your Device as a result of your use of our Service by downloading anti-virus software, maintaining appropriate firewall protections in your Device, keeping your password and/or any identification code secure from any unauthorised access, and clearing or deleting any cookies or stored data cached on your Device once you disconnect from our Service.

  5. Your use of our Service
    1. If: (i) you do not use our Service in any 30-minute period after you have accessed it; or (ii) your Device has been logged into our Service for 24 hours or more, your Device will be automatically logged out.
    2. You may use our Service after your Device has been logged out by attempting to use our Service, and where possible, we will use our reasonable endeavours to automatically reconnect your Device by logging your Device back into our Service.

  6. Our liability to you
    1. We will be liable to you for: (i) death or personal injury arising from our negligence; (ii) fraudulent misrepresentation; or (iii) breach of any implied statutory duty owed to you by us, including that we must provide our Service to you with reasonable skill and care.
    2. You will be liable to us for any loss suffered by us if you, or any other person using your Device to access our Service, breach(es) clause 3 of these Terms.
    3. Subject to clause 6.1, by using our Service you acknowledge and accept that we will not be liable for any:
      1. loss or damage to your Device used to access our Service;
      2. loss or damage to you as a result of any interruptions, delays, errors, defects in operation or unavailability of our Service;
      3. loss or damage to you or your Device as a result of any viruses, bugs, worms, spyware, malware, ransomware, trojan horse, logic bombs or other program or code that may cause harm to you or your Device;
      4. theft or unauthorised use by a third party of the data you send by using our Service;
      5. harmful, graphic or offensive material displayed to you;
      6. charges incurred by you from a third party during or after your use of our Service; or
      7. loss or damage to you that is the result of services provided to us by our agents or subcontractors.
    4. We reserve the right, at any time, to modify, suspend, or discontinue the Service (in whole or in part). We may do this with or without notice to you. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service or any part thereof.
    5. You acknowledge and agree that we will have no obligation to provide you with any support or maintenance in connection with the Service.
    6. Subject to clause 6.1, if you use our Service for commercial or business use, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), and whether foreseeable or not, arising under or in connection with your use of our Free Service for: (i) any loss of profits, sales, business or revenue; (ii) business interruption; (iii) any loss of anticipated savings; (iv); loss of business opportunity, goodwill or reputation; or (v) any indirect loss or consequential damage.

  7. Terminating your access and/or our Service
    1. We may terminate your access to our Service and/or this contract: (i) at any time if we consider that you have accessed or used our Service in violation of these Terms; or (ii) if you have not accessed our Service within 6 months.
    2. You may deregister your Device and terminate this contract at any time by calling us on 0800 389 0917 or via an email to deregister@inlinkuk.com
    3. We may terminate our Service at any time as a result of a legal or regulatory obligation imposed upon us, or for any other reason by providing you with 30 days’ notice via an email to the address you used to register for the service, where possible.

  8. Changes to these Terms and/or our Service
    1. We may make changes to these Terms and/or our Service that are a result of: (i) a change in the law or our business; (ii) necessary for the delivery of our Service; or (iii) any improvements to our Service.
    2. Where possible, we will notify you of any major or important changes to these Terms or our Service in advance via an email to the address you used to register for the service. By continuing to access and use our Service after we have made any changes, you are accepting such changes.

  9. Disputes, complaints and queries
    1. These Terms are governed by English law and we both agree to submit to the non-exclusive jurisdiction of the English courts. This means that, if you are a citizen of a country in the EU, you may bring a claim to enforce your consumer protection rights in connection with these Terms in England or in the EU country in which you live.

  10. Your personal information
    1. Your submission of information, including personal data, through or in connection with the Service and our use of cookies is governed by the terms of our privacy policy as updated from time to time.

  11. Other important terms
    1. Subject to clause 9.1, if any court considers any clause of these Terms is illegal, invalid, or unenforceable, such clause will not apply to you or us (as applicable), and will not affect the validity or enforceability of the remainder of these Terms.
    2. If you or we fail to enforce any term of these Terms, it shall not prevent you or us from enforcing the rights granted to you or us in these Terms.
